1) Acceptance of Terms

By using our website, requesting a quote, booking service, or receiving on-site work (collectively, the “Services”), you agree to these Terms.

2) Services; Estimates & Scope

Estimates. Estimates describe expected labor, materials, taxes/fees, and are not final quotes. Pricing may change if conditions differ, codes require additional work, or parts/labor change. We’ll obtain approval for material changes.

Access & Safety. You’ll provide safe access to equipment/work areas, disclose hazards, and secure pets/children.

Permits & Code. Where required, you authorize us to obtain permits (fees billed to you). Work is performed to applicable codes and manufacturer specs based on the agreed scope.

Refrigerants & Environmental Handling. Handled/recovered per applicable regulations; environmental/disposal fees may apply.

3) Scheduling, Cancellations & Delays

Windows. Appointment windows are estimates; delays can occur due to traffic, weather, emergencies, or parts.

Cancellation/Rescheduling. Please provide ≥24 hours’ notice. Missed/same-day cancellations may incur a service call fee.

Force Majeure. We aren’t liable for delays/failures beyond our reasonable control.

4) Payment Terms

Due Dates. Unless otherwise stated, payment is due upon completion (residential) or per agreed net terms (commercial).

Deposits. Special-order parts/projects may require a non-refundable deposit once ordered.

Late/Collections. Past-due balances may incur a late charge and reasonable costs of collection, including attorneys’ fees as permitted by law.

Non-Payment. We may pause or refuse future service for accounts in arrears.

5) Parts; Returns

Parts & Materials. We may use OEM or equivalent-quality parts.

Returns. Installed/special-order electrical or refrigerant components are generally non-returnable unless defective under warranty.

6) Limited Warranty

Labor. Workmanship is warranted for ___ days from completion (unless stated otherwise in writing).

Parts. Parts carry manufacturer warranties (vary by brand).

Exclusions. Misuse, lack of maintenance, pre-existing conditions, acts of God, power issues, third-party repairs, or unapproved modifications are excluded.

Remedy. Our obligation is repair or replacement of defective workmanship/covered parts within the warranty period. THIS IS YOUR EXCLUSIVE REMEDY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7) Customer Responsibilities

You’re responsible for accurate information; securing personal property near work areas; maintaining equipment per manufacturer recommendations; and paying for service calls if issues are unrelated to prior repairs or due to conditions outside our control.

8) Website & Digital Services

Content. Website content is provided “as is” and may change without notice.

Prohibited Use. No scraping, reverse engineering, or security circumvention.

IP. Trademarks, content, and materials are owned by us or our licensors.

9) SMS/Text Messaging Program

By providing your mobile number, you consent to receive service alerts, appointment updates, estimates/invoices, and occasional marketing texts.

Consent not a condition. Consent isn’t required to purchase.

Opt-out. Text STOP to end. Text HELP for help.

Frequency & fees. Message frequency varies; message/data rates may apply.

Carriers. Carriers aren’t liable for delayed/undelivered messages.

10) Disclaimers; Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND WEBSITE ARE PROVIDED “AS IS” EXCEPT AS EXPRESSLY STATED. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF USE/PROFITS). OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

New Jersey Notice: Nothing here limits your non-waivable rights under New Jersey law (including TCCWNA). If any disclaimer/limitation is unenforceable under NJ law, it applies to the maximum extent permitted.

11) Indemnity

You agree to indemnify and hold us harmless from third-party claims arising out of your misuse of the Services, violation of these Terms, or negligence/willful misconduct.

12) Governing Law; Venue

New Jersey law governs. Exclusive venue lies in the state or federal courts located in Essex County, New Jersey.

13) Changes

We may update these Terms; updates are effective upon posting with a new “Effective Date.” Continued use constitutes acceptance.
